「이민 및 국적법」

□ 개 요 미국의 「이민 및 국적법」(미국법전 제 8 편 제 12 장)은 1952년 6월 27일 제정되었다. 우리나라 ｢출입국관리법｣에 해당하는 이 법은 주로 외국인의 미국 입출국, 체류자격 취득, 국적 취득 등에 대한 기본적 사항을 정하는 총 228 개조로 구성되어 있다. 이 법의 시행은 미국 법무부, 국토안보부, 국무부 등 여러 부처에서 담당하고 있다. 이 중 법조문에 등장하는 이민귀화국(INS)의 경우 2003년 국토안보부가 신설되면서 폐지되었고 그 업무는 대부분 국토안보부 산하 미국이민국(USCIS)으로 이관되었다. 이 요약본의 하단 목차는 2019년 1월 8일자 개정까지 포함하는 원문을 기초로 작성하였다.
