Reference: C.N.346.2006.TREATIES-1 (Depositary Notification) AGREEMENT ON THE CONSERVATION OF SMALL CETACEANS OF THE BALTIC AND NORTH SEAS NEW YORK, 17 MARCH 1992 ADOPTION OF AN AMENDMENT The Secretary-General of the United Nations, acting in his capacity as depositary, communicates the following: By Resolution No. 4, adopted on 22 August 2003 at the 4 th meeting of the Parties to the above Agreement, held in Esbjerg, Denmark, from 19 to 22 August 2003, the Parties adopted an amendment to the Agreement, in accordance with paragraph 6.5. In accordance with paragraph 6.5.3., amendments shall enter into force for those Parties which have accepted them 90 days after the deposit of the fifth instrument of acceptance of the amendment with the Depositary. Thereafter, they shall enter into force for a Party 30 days after the date of deposit of its instrument of acceptance of the amendment with the Depositary. The texts of the amendment in the four authentic languages of the Agreement are transmitted herewith. Reference: C.N.346.2006.TREATIES-1 (Notification Depositaire) ACCORD SUR LA CONSERVATION DES PETITS CETACES DE LA MER BALTIQUE ET DE LA MER DU NORD NEW YORK, 17 MARS 1992 ADOPTION D'UN AMENDEMENT Le Secretaire general de !'Organisation des Nations Unies, agissant en sa qualite de depositaire, communique : Par la Resolution n° 4, adoptee le 22 aout 2003 lors de la 4ieme reunion des Parties a I'Accord susmentionne, tenue a Esbjerg, Danemark, du 19 au 22 aout 2003, les Parties ont adopte un amendement al' Accord, conformement au paragraphe 6.5. Conformement au paragraphe 6.5.3, les amendements entrent en vigueur a l'egard des Parties qui les ont acceptes quatre-vingt-dixjours apres le depot du cinquieme instrument d'acceptation de l'amendement aupres du Depositaire. Ensuite, ils entrent en vigueur a l'egard d'une Partie trente jours apres le depot de !'instrument d'acceptation de celle-ci aupres du Depositaire. Les textes de l'amendement se trouvent, ci-joints, dans les quatre langues authentiques de !'Accord.
Replace Article 1.2 (b) with "Area of the Agreement means the marine environment of the Baltic and North Seas and contiguous area of the North East Atlantic, as delimited by the shores of the Gulfs of Bothnia and Finland; to the south-east by latitude 36°N, where this line of latitude meets the line joining the lighthouses of Cape St. Vincent (Portugal) and Casablanca (Morocco); to the south-west by latitude 36°N and longitude 15°W; to the north-west by longitude 15° and a line drawn through the following points: latitude 59°N/longitude 15°W, latitude 60°Nllongitude 05°W, latitude, 61°Nllongitude 4W;latitude 62NI longitude 3W; to the north by latitude 62°N; and including the Kattegat and the Sound and Belt passages."
Add a new subparagraph 6.5.4 to Article 6.5 reading as follows: "Any State that becomes a Party to the Agreement after the entry into force of an Amendment shall, failing an expression of a different intention by that State: a) be considered as a Party to the Agreement as amended; and b) be considered as a Party to the unamended Agreement in relation to any Party not bound by the Amendment."
Change the name of the Agreement to: Agreement on the Conservation of Small Cetaceans of the Baltic, North East Atlantic, Irish and North Seas.
Remplacer !'Article 1.2 (b) par ce qui suit : << La "zone couverte par !'Accord" designe le milieu marin de la mer Baltique et de la mer du Nord, ainsi que la zone contigue du nord-est de !'At/antique, delimites par !es cotes des golfes de Botnie et de Finlande; au sud-est par la latitude 36°N la ou cette ligne de latitude rencontre la ligne reliant !es phares du Cap St. Vincent (Portugal) et de Casablanca (Maroc) ; au sud-ouest par la latitude 36°N et la longitude 15°0; au nord-ouest par la longitude 15° et une ligne reliant !es points suivants : latitude 59°N/longitude 15°0, latitude 60°N/longitude 5°0), latitude 61°N/longitude 4°O;latitude 62°Nllongitude 3°0; au nord par la latitude 62°N; et incluant !es detroits du Kattegat, du Sund et des Belt. >>
Ajouter le sous-paragraphe 6.5.4 a !'Article 6.5 se lisant comme suit : << Tout £tat devenant Partie a !'Accord apres l'entree en vigueur d'un amendement sera, faute d'avoir exprime une intention differente : a) considere comme etant une Partie a l Accord amende; et b) considere comme etant une Partie a !'Accord non amende par rapport a toute Partie qui n'est pas lie par /'Accord. >>
Changer le nom de !'Accord pour:
Accord sur la conservation des petits cetaces de la mer Baltique, du nord-est de !'At/antique et des mers d'lrlande et du Nord.
