2020 No. 1486 Exiting The European Union Consumer Protection Weights And Measures, Northern Ireland

The Secretary of State makes the following Regulations in exercise of powers conferred by section 8C(1) of, and paragraph 21 of Schedule 7 to, the European Union (Withdrawal) Act 2018.
These Regulations may be cited as the Product Safety (Toys and Cosmetics) and Metrology (Measuring and Non-automatic Weighing Instruments) (Amendment) (EU Exit) Regulations 2020.
This regulation and regulation 2 come into force immediately before Part 4 of the Product Safety and Metrology etc. (Amendment etc.) (UK(NI) Indication) (EU Exit) Regulations 2020 comes into force.
Regulation 3 comes into force immediately before IP completion day.
This regulation extends to England and Wales, Scotland and Northern Ireland.
Regulation 2 extends to England and Wales and Scotland only.
Regulation 3 extends to Northern Ireland only.
In Schedule 3 to the Product Safety and Metrology etc. (Amendment etc.) (UK(NI) Indication) (EU Exit) Regulations 2020, in paragraph 9(4), in the inserted regulation 39AB(3)(b)(iii), for “regulated measuring instrument” substitute “toy”.
In the Product Safety and Metrology etc. (Amendment) (Northern Ireland) (EU Exit) Regulations 2020—
in Schedule 6 (cosmetic products enforcement) after paragraph 1(6) insert—
In regulation 20—
in paragraph (1) omit “England and Wales or”;
omit paragraph (5)(a);
in the text following paragraph (5)(b) omit from “section 111” to “1980, or”.
in Schedule 13 (non-automatic weighing instruments) omit paragraph 2(1)(h);
in Schedule 14 (measuring instruments)—
for paragraph 2(1)(e) substitute—
in the definition of “make available on the market” for “European Economic Area” substitute “relevant”;
after paragraph 2(1)(e) insert—
in the definition of “place on the market” for “market, in the European Economic Area” substitute “relevant market”;
omit paragraph 2(1)(g).
