(1) Every copy of a consolidated statute or consolidated regulation published by the Minister under this Act in either print or electronic form is ev- idence of that statute or regulation and of its contents and every copy purporting to be published by the Minister is deemed to be so published, unless the contrary is shown. in Acts (2) In the event of an inconsistency between a consolidated statute published by the Minister under this Act and the original statute or a subsequent amendment as certified by the Clerk of the Parlia- ments under the Publication of Statutes Act, the orig- inal statute or amendment prevails to the extent of the inconsistency. TITRE ABRÉGÉ 1. This Act may be cited as the Department of Fisheries and Oceans Act.

1978-79, c. 13, s. 2. ESTABLISHMENT OF THE DEPARTMENT

1. Loi sur le ministère des Pêches et des Océans. 2. (1) There is hereby established a department of the Government of Canada called the Department of Fisheries and Oceans over which the Minister of Fisheries and Oceans appointed by commission under the Great Seal shall preside.

2. (1) Est constitué le ministère des Pêches et des Océans, placé sous l’autorité du ministre des Pêches et des Océans. Celui-ci est nommé par commission sous le grand sceau. (2)

The Minister holds office during pleasure and has the management and direction of the Department. 1978-79, c. 13, s. 3.

(2) 3. The Governor in Council may appoint an officer called the Deputy Minister of Fisheries and Oceans to hold office during pleasure and to be the deputy head of the Department.

(1) The powers, duties and functions of the Minister extend to and include all matters over which Parliament has jurisdiction, not by law assigned to any other department, board or agency of the Government of Canada, relating to

4. (1) Les pouvoirs et fonctions du ministre s’étendent d’une façon générale à tous les domaines de compétence du Parlement non attribués de droit à d’autres ministères ou organismes fédéraux et liés : (2)

a) à la pêche côtière et à la pêche dans les eaux internes; b) aux ports de pêche et de plaisance; c) à l’hydrographie et aux sciences de la mer; The powers, duties and functions of the Minister also extend to and include such other matters, relating to oceans and over which Parliament has jurisdiction, as are by law assigned to the Minister. 1978-79, c. 13, s. 5. AGREEMENTS

(2) 5. The Minister may, with the approval of the Governor in Council, enter into agreements with the government of any province or any agency thereof respecting the carrying out of programs for which the Minister is responsible.

5. Le ministre peut, avec l’approbation du gouverneur en conseil, conclure avec les gouvernements des provinces ou leurs organismes des accords relatifs à la réalisation de programmes relevant de sa compétence. 6. The Minister shall, on or before the 31st day of January next following the end of each fiscal year or, if Parliament is not then sitting, on any of the first five days thereafter that either House of Parliament is sitting, submit to Parliament a report showing the operations of the Department for that fiscal year.

6. Le 31 janvier au plus tard ou, si le Parlement ne siège pas, dans les cinq premiers jours de séance ultérieurs de l’une ou l’autre chambre, le ministre dépose devant le Parlement le rapport d’activité de son ministère pour l’exercice précédent.
