As used in this chapter: (7) "Consent" means that at the time of the act of sexual intercourse or sexual contact there are actual words or conduct indicating freely given agreement to have sexual intercourse or sexual contact.
(1) A person is guilty of rape in the third degree when, under circumstances not constituting rape in the first or second degrees, such person engages in sexual intercourse with another person: (a) Where the victim did not consent as defined in RCW 9A.44.010(7), to sexual intercourse with the perpetrator and such lack of consent was clearly expressed by the victim's words or conduct, or (b) Where there is threat of substantial unlawful harm to property rights of the victim. (2) Rape in the third degree is a class C felony.

이 장에서 사용하는 용어의 정의는 다음과 같다. ⑦ "동의"란 성교 또는 성적 접촉 등 행위가 이루어질 당시 성교 또는 성적 접촉을 갖기로 자유롭게 내린 합의를 나타내는 실제 언어 또는 행동이 존재함을 말한다.
① 1급 또는 2급 강간의 구성요건을 갖추지 아니하고 다음 각호의 경우에 해당하는 상황에서 타인과 성교에 관계하는 사람은 3급 강간의 죄에 해당한다. 1. 피해자가 가해자와 성교를 하겠다는 제9A편 제44장 제010조제7항에서 정의하는 동의를 하지 아니하였으며 그러한 동의의 결여가 피해자의 말 또는 행동을 통하여 분명히 표현된 경우 2. 피해자의 재산권에 실질적으로 불법적 손해 위협이 있는 경우 ② 3급 강간은 C형 중범죄이다.
