The Law f Ukraine On Stimulating the Development of Regions

This Law determines the principles for the implementation of state regional policy as regards to stimulating development of regions and overcoming depressiveness of regions.
Stimulating development of regions is a complex of measures aimed at the achievement of stable development of regions by combining economic, social and ecological interests on the national and regional levels, maximum efficient use of potential of regions in the interests of their residents and state on the whole.
The agreements between the Cabinet of Ministers of Ukraine and the Supreme Council of the Autonomous Republic Crimea, oblast, Kyiv, Sevastopol city councils are concluded for state stimulating development of regions.
The initiator of concluding the agreement on regional development may be the Cabinet of Ministers of Ukraine, central bodies of executive power, the Supreme council of the Autonomous Republic of Crimes, oblast, Kyiv and Sevastopol city councils. The initiator ensures working out the project of the agreement on regional development in compliance with the requirements set by this Law.
The decisions about the need of concluding agreement on regional development are adopted by the Cabinet of Ministers of Ukraine and the Supreme Council of the Autonomous Republic Crimea, oblast, Kyiv, Sevastopol city councils.
The agreement on regional development is signed by the Prime Ministers of Ukraine (or other person on the instruction of the Cabinet of Ministers of Ukraine) and respectively the Head of the Supreme Council of the Autonomous Republic Crimea, the head of oblast, Kyiv, Sevastopol city councils or Kyiv City Head.
The agreement on regional development enters into force after its approval by the Supreme Council of the Autonomous Republic Crimea, oblast, Kyiv, Sevastopol city councils.
Depressive territory is the region or its part (district, city) which level of development by the indices is the lowest among the territories of respective type. The monitoring of development indices of regions, districts, cities is conducted by: · the central body of executive power on economic policy; · the Council of Ministers of the Autonomous Republic Crimea; · oblast, Kyiv and Sevastopol city state administrations.
According to the monitoring results the Cabinet of Ministers of Ukraine determines: · the territories granted the status of depressive, sets their boundaries; · the term for which the territory gets the status of depressive; · the measures for state stimulation of the development of territory with the purpose of overcoming depressive state, form and condition of its application.
The term for which the territory gets the status of depressive shall not exceed seven years. If the territory according to the development indices remains depressive, the Cabinet of Ministers of Ukraine upon agreement with the respective local council of the territory that is recognized depressive may prolong this term, but not more than for five years.
The following measures may be taken for stimulating the development of depressive territories: · granting state support, including financial, to small enterprises, promoting formation of business centers, business-incubators, innovation and consulting centers, venture funds, etc.; · directing international technical aid at the solution of actual social economic and ecological problems; · promoting population employment, ensuring financing the programs of retraining and professional development of labor resources, stimulating labor migration, improving social sphere, in particular house-building, healthcare and environmental protection.
The respective program is developed for overcoming depressiveness of territory.
Stimulating development of regions and overcoming depressiveness of territories are financed at the expense of funds envisaged by: · the State Budget of Ukraine; · local budgets for the respective years; · other sources according to the legislation.
