Law of Ukraine On Access to Judicial Decisions
Date of entry into force: June 1, 2006
This Law defines the procedure for access to the judicial decisions (decisions, court orders, findings of courts, sentences, rulings) made by the common law courts, and keeping the Unified State Register of Judicial Decisions.
Everyone has right to access the court decisions via: Official publication of court decisions at the official web-portal of the Judicial Power of Ukraine; Publishing of the decisions in printed publications; Spreading of decisions in electronic format.
All the decisions of the common law courts are added to the Unified State Register of Judicial Decisions. This Register is kept by the State Judicial Administration of Ukraine and places it at the official web-portal of the judicial power of Ukraine. Reconsideration of the court decisions, listed in the Register, is open and free and may be made round the clock.
Access to court decisions, listed in the Register, allows to perform: Search; Revision; Copying; Printing of court decisions or their parts.
Court decisions, listed in the Register, may be officially published in printed media. In this case a court decision should be testified by the State court administration of Ukraine for the authenticity to the originals or electronic copies of judicial decisions, listed in the Register.
Only the text of judicial decision, officially published or listed in the Register may be used at reinforcement of legal procedure.
Everyone has right to reproduce completely or partially the court decisions, proclaimed by the court in public or in any other way. And editing of the court decision text shall not distort its content.
The Law defines restrictions on divulgence of information in the texts of the judicial decisions, which can identify the natural person. In particular: Names of natural persons (except for surnames and initials of a judge, other officials involved in a case, fulfilling their duties);
addresses of place of residence of natural persons, telephone numbers, e-mail addresses, identification number (codes);
registration numbers of vehicles.
If a judicial decision concerns rights, freedoms, interests or duties of a person, but he would not take part in a case, then he can turn to a corresponding court with written application about the following: rendering opportunity to get familiarized with a court decision;
rendering possibility to make copies of court decision in the court building with the help of own technical means;
making copies of a judicial decision by the judicial bodies. At the same time the copy of a judicial decision is given for a payment, the size of which is fixed by the Cabinet of Ministers of Ukraine.
