Jessica 법률은 아동에 대한 성범죄자(child sex predators)를 처벌하고, 재범의 가능성을 줄이기 위하여 2005년에 제정된 플로리다주 법률에 대한 비공식명칭이다. 이 법률의 명칭은 2005년 2월 성범죄자였던 John Couey가 어린 소녀인 Jessica Lunsford를 강간살해하였는데, 피해자인 소녀의 이름에서 유래한다.

이 강간살해사건은 대중의 격분을 일으켰고, 이에 따라 플로리다주는 이 법안을 의결하였다. 이 법안의 주요내용은 12살미만의 자에 대한 성범죄(lewd or lascivious acts)로 유죄판결을 받은 성범죄자에게 의무적으로 최저징역기간 25년(mandatory minimum sentence of 25 years in prison)을 부과하고, 평상동안 추적장치를 부착하도록 하고 있다.

Jessica 법률은 또한 플로리다주 법률과 유사한 다른 주의 법률을 지칭할 때에도 사용되고 있다. 몇 개의 주에서는 이미 Jessica 법률을 도입하였고, 캘리포니아주도 그 중 하나이다. 미연방에서도 Jessica Lunsford Act(H.R. 1505 of the 109th Congress)이 하원에 제안되어있는  상태이다.

캘리포니아의 제시카 법률(주민발안 83)의 주요 내용

① 의무적 최저징역기간: 15년이상 또는 종신형

  - 14세 미만의 아동을 강간한 성범죄자에게 최저 15년이상 종신형(mandatory minimum of 15 years to life)을 의무적으로 부과한다. 강제적인 성행위로 유죄판결을 받은 자는 연속적이고(consecutive), 감형없는 징역형을 받도록 한다.  예를 들면 성범죄자가 동일한 아동을 3회에 걸쳐 성추행하였다면, 그는 최소 45년의 징역형을 선고받아야만 한다. 또한 중대한 성범죄자의 경우 최소한 25년 형의 징역을 선고하도록 함으로써 종전 법의 허점으로 지적되던 감형할 수 있는 판사의 재량을 부여하지 않는다. 

성범죄를 할 의도로 유괴한 경우와 성범죄를 할 의도로 주거침입을 한 범죄자에 대하여 의무적 종신형(mandatory minimum sentencing of life)을 선고받도록 하였다. 이 경우에는 가석방의 가능성을 열어두고 있다.

② 복역하고 있는 죄수들에 대한 감형의 기회를 부여하지 않고(Eliminates good-time and work-time credits for sex offenders), 최초에 선고받은 징역형을 모두 복역하여야 출소가 가능하도록 함.

③ 평생동안 전자추적장치부착의무화

 - 등록된 중대한 성범죄자(registered felony convicted sex offenders)는 평생동안 위치추적장치(GPS)를 착용하도록 하고, 이에 대한 비용도 원칙적으로 그들이 부담하도록 함.

Jessica's Law

Jessica's Law is the informal name given to a 2005 Florida law designed to punish child sex predators and reduce their ability to re-offend. The law is named after Jessica Lunsford, a young Florida girl raped and murdered, allegedly by John Couey, a previously convicted sex offender, in February 2005. Public outrage over this case spurred Florida officials to introduce this legislation. Among the key provisions of the law are a mandatory minimum sentence of 25 years in prison and lifetime electronic monitoring of adults convicted of lewd or lascivious acts against a victim less than twelve years of age. In Florida, sexual battery or rape of a child less than twelve years of age is a capital felony, punishable only by death or life imprisonment with no chance of parole.

Jessica's Law is also used to designate all legislation and potential legislation in other states modeled after the Florida law. Several states have introduced such legislation since Florida's law was passed. A version of Jessica's Law has been introduced on the federal level as well; see Jessica Lunsford Act.

Key Provisions

MANDATORY MINIMUM SENTENCES ? 15 to 25 years to life

Ensures California has a mandatory minimum of 15 years to life for any offender that rapes a child under the age of 14. 

For every convicted forcible sex act, the offender will receive consecutive, full-term sentences.  (For example, if an offender molests the same child three times, in the span of several hours, the offender will receive 45 years to life or 3 consecutive sentences).

Ensures all egregious sex offenders serve at least 25 years by closing loophole in California law that allows judges to reduce sentences.

Adds more crimes like continuous sexual abuse of a child to be charged 15-25 years to life. Adds the crime of kidnapping with the intent to commit a forcible sex crime and adds burglary with the intent to commit a forcible sex crime to the mandatory minimum sentencing of life with the possibility of parole.

ENSURES SEX OFFENDERS SERVE THEIR FULL SENTENCE

Eliminates good-time and work-time credits for sex offenders.

ELECTRONICALLY MONITORS SEX OFFENDERS FOR LIFE -- GPS

Requires registered felony convicted sex offenders to wear a GPS tracking device for life. Requires offenders to pay for their own GPS equipment, if they are financially able.

STRENGTHENS SEXUALLY VIOLENT PREDATOR PROGRAM

Creates an indeterminate term of commitment to keep sexually violent predators away from our communities. Reduce the number of predicate sexually violent crimes from 2 to 1. Requires SVP’s parole period to begin discharge from the state hospital.

Add continuous sexual abuse of a child and the attempt to commit qualifying SVP crimes to the list of offenses that qualify for sexually violent crime designations.

PREDATOR-FREE ZONES

Prohibits registered sex offenders from living within 2,000 feet of any school or park.

Allows local governments to include additional sites they deem appropriate, such as a water park.

INCREASES PENALTIES FOR POSSESSION OF CHILD PORNOGRAPHY

Allows possession of child pornography to be prosecuted as a felony.

PROTECTS CHILDREN FROM INTERNET PREDATORS

Allows law-enforcement to act as decoys in order to engage and capture Internet predators.

CRACKS DOWN ON RAPISTS THAT DRUG THEIR VICTIMS

Imposes an additional 5-year prison term for persons who drug their victims in the commission of specified sexual crimes, such as rape.

INCREASES PAROLE TERMS

Provides for parole terms of up to 10 years for the most heinous sex offenses (current law provides for parole terms from 3-5 years for various sex offenses).
