총기난사에 연루된 뉴욕시경찰관 3명에 기소결정내린 대배심

대배심(grand jury)은 지난 금요일(2007.03.16.) 무장하지 않은 남자를 50발의 총기난사로 죽인 5명의 뉴욕경찰관들 중 최소한 3면에 대하여 기소결정을 하였다. 다른 경관들이 기소되었는지에 대하여는 아직 밝혀지지 않고 있다.

이들 경찰관들의 변호사는 의뢰인의 기소는 결정되었으나, 어떤 죄로 기소되었는지는 아직 모른다고 말했다.

기소결정된 3명의 경찰관(Cooper이 4발, Isnora이 11발, 그리고, Oliver가 31발)이 작년(2006년) 11월 25일 발생한 대치과정에서 23살의 Sean Bell을 사살하였고, 그의 두 친구에게도 상해를 입혔다.

총기난사로 인해 뉴욕시민들은 분노하고 있고, 뉴욕경찰이 인종차별을 하고 있다고 비난하고 있다.  사살된 Bel은 흑인이고, 상해을 입은 그의 두 친구도 흑인이다. 두명의 경찰관은 백인이고, 나머지 3명은 흑인이다.

대배심의 결정은 3일간의 심리후 내려진 것이다.

Al Sharpton 목사는 기소결정은 이 사건의 정의를 위한 투쟁에서 중요한 첫 단계가 될 것이라고 말했다.

“지난 11월 25일 이후, 우리는 함께 투쟁해 왔다. 오늘은 이 싸움에서 중요한 날이다. 이것이 의미있는 전진인지여부는 더 지나봐야 알 것이다. 그러나 오늘 분명히 말할 수 있는 것은 만일 우리가 단결해 투쟁하면, 우리는 아이들을 보호하기 위하여 필요한 것들을 할 수 있을 것이다.”라고 그는 기자회견에서 말했다.

뉴욕시에서는 대배심의 결정에 대하여 관심이 매우 높았다. 많은 경찰이 대배심에서 증언을 하였으며, 시장은 대배심의 결정이 야기할 긴장을 완화시키기 위하여 총기난사사고가 발생한 Queens 지역의 흑인리더들을 만났다.

Michael Bloomberg 시장은 지난 금요일 "대배심이 어떠한 결정을 내리든 뉴욕시민들은 모범적인 행동을 보일 것이라고 나는 생각한다.”라고 말했다. “시민들은 실망할 수 있고, 그들의 의견을 개진할 수 있다. 이것이 언론의 자유(freedom of speech)고, 이것에 대하여 나는 잘못된 점을 찾을 수 없다. 그러나 어떤 사람도 길거리로 뛰쳐 나가서 거리를 불안하게 만들지는 않을 것이다.”라고 그는 말했다.

23명의 대배심이 이 사건의 심리를 맡았고, 기소결정을 내리기 위해서 12명의 배심원들의 찬성이 필요하다.  대배심의 구성은 흑인이 8명, 백인이 7명, 나머지 8명은 히스패닉계와 아시아계이다.

Bell의 죽음으로 인하여 경찰관들에 대해 대배심이 기소할 수 있는 범죄는 2급살인죄(second-degree murder), 경살인죄(manslaughter) 또는 과실살인(criminally negligent homicide)이고, 두 친구의 부상으로 인하여 기소할 수 있는 범죄는 살인미수(attempted murder), 폭행죄(assault) 등이다.

(AP) - NEW YORK-A grand jury Friday indicted at least three of the five police officers whose 50-shot barrage killed an unarmed man on his wedding day, lawyers for the officers said. It was not immediately disclosed if the other officers were also charged.

Attorneys for officers Marc Cooper, Gerscard Isnora and Michael Oliver said their clients had been indicted, but they did not know what offenses the officers had been charged with.

The three officers fired the most shots - Cooper, 4, Isnora, 11, and Oliver, 31 - in the Nov. 25 confrontation that killed 23-year-old Sean Bell and wounded two of his friends.

Isnora, 28, was "very upset," attorney Philip Karasyk said. "But he is confident that once he has his day in court he will be vindicated."

The shooting stirred outrage around New York City and led to accusations of racism against police. Bell was black, as are two of his friends who were wounded in the shooting. Two of the officers are white, and three are black.

The grand jury's decision came after three days of deliberations.

The Rev. Al Sharpton said the charges marked an important first step in the fight for justice in the case.

"Since Nov. 25th, we have battled together. Today is a major step in that battle, whether it will be a step forward, time will tell. But one thing that we can say, if you stay together and you fight, you can do what is necessary to protect children," the Rev. Al Sharpton said at a news conference.

Anticipation has been running high around New York City about the grand jury's decision. Extra police officers were put on standby, and the mayor met with black leaders in the Queens neighborhood where shooting occurred in hopes of defusing any tensions that might arise from the decision.

"Whatever the grand jury says ... I think you will see the people of this city behaving in an exemplary manner," Mayor Michael Bloomberg said Friday. "They can be disappointed, they can express themselves - that's freedom of speech, I don't have a problem with that. But nobody is going to go out and make our streets unsafe."

A 23-person grand jury heard the case, and 12 grand jurors needed to vote for an indictment for charges to be brought. The panel includes eight blacks, seven whites, and a mix of Hispanics and Asians.

Grand jurors had been instructed to consider several charges: second-degree murder, manslaughter or criminally negligent homicide stemming from Bell's death; and attempted murder, assault or reckless endangerment in the wounding of survivors Trent Benefield and Joseph Guzman.
